Expert Determinations
An expert determination is a form of ADR (alternate dispute resolution) where a resolution is based upon the determinations of a third party.
An agreement is entered by each disputant where they agree to be bound by the decisions of the independent expert. This form of resolution is generally the most cost effective and quickest method of resolving disputes.
Expert Witness
An expert witness is a person with a depth of knowledge of the building industry, regulations, Codes and requirements to build and complete a structure to an acceptable standard
Persons requiring the services of an expert witness include builders, owners, owner’s corporations, that have a problem or defect within a building or property and require support in litigation to substantiate that claim. Where litigation is not undertaken, then the expert can provide solutions to building defects and problems.

This covers all aspects from site selection and initiation, setup, demolition, excavation, ground works, construction, lockup and fit out through to handover.
Mediation
Mediation is another form of alternative dispute resolution between disputing parties where the outcomes are final. Mediators are an independent third party engaged to assist the parties negotiate a settlement, thus avoiding lengthy and costly litigation.
Project Management
A project manager is tasked with planning, organising and controlling the contractors, protocols and procedures with in a project. Their role is to complete a project whilst meeting all constraints pertaining to scope, quality, budget and time.
Security of Payments Act Claims
The security of payments act has undergone a series of changes and amendments effective of April 2014.
Amendments have been made pertaining to:
- The prompt payment terms for progress payments.
- Requirement that payment claims made by the head contractor are submitted with supporting documents declaring that engages subcontractors have been paid what is due and payable.
- Removal of the requirement that a payment claim must state that it is being made under the Act.
